Talk on Informed Consent Re-visited – 14 months on since the decision in Hii Chii Kok

Synopsis

On 12 May 2017, the Court of Appeal adopted a new legal standard for informed consent in its decision in Hii Chii Kok v Ooi Peng Jin London Lucien and another (“Hii Chii Kok”, CA 33/2016), bringing to life what is now known as the modified Montgomery Test in Singapore law. 

A Doctor’s duty to advise has shifted from a paternalistic approach to one that strives for a balance of doctor and patient’s interests. In taking a bold step and moving away from the “reasonable doctor” test (i.e. the Bolam/Bolitho test) to the “reasonable patient” test in the area of medical advice, the Court of Appeal’s decision was understandably greeted with reservation by the medical fraternity.  With the benefit of hindsight, the question now is whether such reservation was in fact justified?

14 months on from the delivery of this landmark decision, MOHH and JLT jointly present a medico-legal lecture on the development of the law on informed consent as part of the Continuing Education Initiative under the Doctors’ MMI Programme.  The lecture will, amongst others, address the following issues: how has the law on informed consent further developed in Singapore since Hii Chii Kok, what are the cases now seen before the Singapore Courts, and how has this landmark decision influenced the practice of medicine in the area of medical advice.
