Synopsis

Evidence suggests that the relationship between medical errors and litigation is complex. Therefore, understanding why patients sue their doctor and what they are hoping to achieve is an important step in taking action to minimise the risk of litigation.

The aim of the Risk Management Workshop is threefold:
1. To understand what medical negligence is in a legal context
2. To understand the drivers of negligence claims
3. How to avoid litigation.

In order to avoid litigation, the workshop highlights how good practices, including good record keeping, open dialogue with patients, clear guidance and protocols, saying sorry, and swift, transparent and comprehensive complaint and incident management, contribute to a reduction in litigation.

Speakers

Jessica Lewis (LLB (Hons))
Jessica is a qualified solicitor having worked in private practice for ten years defending hospitals, doctors and nurses for various clients, including the NHS Resolution, Medical Defence Union and various insurers. Jessica has handled claims concerning catastrophic brain injury, infection, amputation and delayed diagnosis, as well as niche issues regarding informed consent and whether or not a duty of care is owed. In addition, Jessica has run a number of high profile cases in respect of medical devices in the UK.

Caroline White (LL.M BSc DipHE RN MBILD)
Caroline is based in London, England, and is responsible for CNA Hardy’s International Healthcare Risk Control. She has over 25 years’ diverse experience in the healthcare sector, having worked clinically at nurse consultant level as a specialist practitioner for blood transfusion, and managerially to Board level.

Prior to joining CNA Hardy, Caroline ran her own interim management and consultancy company for 8 years, providing clinical, integrated governance and risk management services to the health service, and latterly nurse expert witness/legal nurse consultant services.

Khoo Yingxiang, Head, Mediation Unit
Yingxiang graduated from NUS Law School in 2006. She practiced as a pro bono lawyer specializing in charities at Allen & Gledhill LLP for 6½ years. She left A&G in 2014 to pursue her interests in medical disputes and clinical ethics, graduating with a Masters in Medical Ethics and Law from King’s College London in 2015. She is currently Head of the MOH Holdings Healthcare Mediation Unit.
